Safetyism, characterized by an increasing societal emphasis on minimizing harm and risk, has reshaped juror perceptions, attitudes, and expectations, leading them to prioritize perceived safety over traditional notions of personal responsibility. This session will explore the origins of safetyism, its psychological and social impacts on jury dynamics, and its specific implications for various civil cases, including personal injury and product liability claims. This presentation is especially relevant for claims professionals, as the trend of safetyism directly affects how claims are filed, evaluated, and settled. As jurors increasingly demand absolute safety, claims professionals must navigate heightened scrutiny regarding defendants' safety measures and prepare for trial outcomes that reflect these evolving biases.

Insight Session 3: Who's Training Your AI: Why HITL Is Essential for Claims Management Success
11:05 AM-11:25 AM
Insight
Texas Prefunction

As claims management evolves, the future belongs to those who can blend the speed of AI with the critical thinking of human experts. While AI is delivering real value today and offers immense potential, it isn’t infallible. Claims are complex and getting them right requires more than just automation. Without a Human-in-the-Loop (HITL) approach, AI systems can fall short – misinterpreting critical claims details, exposing organizations to legal risks, and delivering inaccurate outcomes for claimants.

This 20-minute session dives into the importance of maintaining human oversight in the claims process to ensure accuracy, mitigate compliance risks, and uphold trust. Explore how HITL safeguards against the pitfalls of fully automated AI systems supports claims professionals rather than replacing them and achieves better outcomes for claimants and organizations. Learn how HITL positions organizations to stay ahead in an evolving landscape and why the human touch is critical in making AI work for your organization – not against it.

This session will examine how technological advances from OEMs will impact litigation, shifting the focus from individual negligence cases to high-stakes product liability lawsuits concerning design, manufacturing, or warning defects. New York’s infamous Labor Law has fueled lawsuits using a strict liability standard, making the construction industry a prime target for personal injury litigation with plaintiff’s encouraged to inflate the nature and extent of their injuries and damages.  Construction costs have soared, carriers have exited the market, retention points have increased making NY one of the hardest places in the nation for construction companies.  Defense lawyers, builders and carriers work hard to root out suspect cases, all at a substantial cost, but the fraudulent cases have increased in volume fueled by a cottage industry of lawyers, unions, doctors, experts and more.  Tradesman filed a shocking RICO complaint based on the fraud, and ABC has exposed a series of fraudulent claims, both which have fueled awareness of the issue.  This session provides context to the investigation, discusses best practices for stakeholders facing a suspect claim, provides tools to attack and punch back, and avoid unnecessary costs and inflated settlements/verdicts.

Insight Session 6: Medical Records, Ethics & the Insurance Game: What No One Talks About
10:50 AM-11:10 AM
Insight

Texas Prefunction
Medical records are supposed to be the backbone of every claim, the final word on what’s real and what’s not. But anyone who’s been in this industry long enough knows—it’s not that simple. Mistakes happen. Information gets left out, misinterpreted, or manipulated. And now, AI is making its way into the process, bringing up a whole new set of ethical dilemmas.

In this lively, unfiltered conversation, a physician with deep expertise in medical ethics will break down what’s actually inside these records, why they aren’t always reliable, and how adjusters can protect themselves from bad data leading to bad decisions. We’ll discuss the fine line between due diligence and overreach, what records really tell us (and what they don’t), and how insurance professionals can avoid being misled—without slowing down the claims process.

We’ll also get into the uncomfortable reality: Most people reviewing these records don’t have a medical background. They’re expected to trust whatever gets put in front of them, even when red flags are staring them in the face. So, what’s the solution? How can adjusters ensure they’re getting the right records, the right way, without the headache?

This isn’t just another ethics talk—it’s a conversation that could change the way you think about medical records forever.20 minute hot takes on trending topics in insurance and technology.  Presenter and exact topic TBD.
